By accessing or using the website https://greenwatt.co.za (“the Site”), placing an order, or engaging with our services, you agree to be bound by the following Terms of Service (“Terms”). Please read them carefully.

1. General

  • These Terms govern all use of our website, products, and services.

  • Green Watt Energy Solutions (PTY) Ltd (“we,” “our,” “us”) reserves the right to amend these Terms at any time without prior notice. Updated Terms will be posted on our website and are binding upon publication.

  • It is your responsibility to review the Terms regularly.

2. Pricing & Quotations

  • All prices displayed on the Site are indicative only and may change without notice due to supplier costs, currency fluctuations, and market conditions.

  • A formal written quotation provides the only binding price and is valid only for the period stated therein.

  • Orders placed at outdated or incorrect prices will be paused until corrected and confirmed by the customer in writing.

  • We reserve the right to refuse or cancel any order prior to dispatch, including where pricing errors are identified.

3. Orders, Payment & Ownership

  • Orders are only confirmed once full payment has been received and cleared in our account.

  • Ownership of goods passes to the customer only once full payment has been made.

  • Until payment is received, we reserve the right to withhold, delay, or cancel delivery.

4. Delivery & Risk

  • Unless otherwise agreed in writing, delivery timelines are estimates only and not guaranteed.

  • Risk in the goods passes to the customer once the goods leave our premises or upon collection by a courier/customer, whichever occurs first.

  • Orders are shipped without insurance unless expressly arranged and paid for by the customer.

  • We accept no responsibility for loss, theft, or damage during transit. Customers must pursue claims directly with the courier where applicable.

5. Warranty

  • Goods are covered strictly by the manufacturer’s warranty only.

  • We act solely as a facilitator of warranty claims and are not responsible for the manufacturer’s decision, timelines, or outcomes.

  • Warranties are void if:

    • Installation is not performed by a qualified professional.

    • Manufacturer’s specifications or guidelines are not followed.

    • The product is damaged due to negligence, misuse, electrical surges, improper storage, or unauthorised modifications.

  • All warranty-related transport, removal, and reinstallation costs are the responsibility of the customer.

6. Returns, Cancellations & Refunds

  • Cancellations after 48 hours of order confirmation are subject to a minimum 10% handling fee.

  • Returned goods will only be accepted if:

    • They are unused, sealed in their original packaging, and in saleable condition.

    • They pass our inspection and quality checks.

  • Installed, damaged, altered, or tampered goods are not eligible for return or refund.

  • All returns are at the customer’s expense.

7. Limitation of Liability

  • To the maximum extent permitted by law:

    • We shall not be liable for any indirect, consequential, punitive, or incidental damages, including but not limited to financial losses, downtime, or loss of business.

    • Our total liability, whether in contract, warranty, or delict (tort), shall not exceed the amount paid by the customer for the specific goods giving rise to the claim.

  • Customers are solely responsible for ensuring products are suitable for their intended use and for obtaining professional installation.

8. Electronic Communications

  • By using our Site, placing an order, or contacting us electronically, you consent to receive communications from us by email, SMS, or other electronic means.

9. Governing Law

  • These Terms are governed by and interpreted in accordance with the laws of the Republic of South Africa.

  • Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
